In Pennsylvania, employees are considered to be “at will,” meaning that they can be terminated for virtually any reason except those that are protected by law or Federal Statute. Your employer can be mean, they can yell, they can fire you for wearing an orange shirt one day.  What your employer cannot do is violate Federal Statute, violate State Law, or violate your Contract if you have one.  

Employers also cannot fire you for filing a Workers’ Compensation action. If you were hurt on the job and are pursuing an action for Worker’s Comp or Workers’ Compensation, your employer cannot retaliate, and fire you for pursing a claim for being injured on the job.  Shick v. Shirey 716 A.2D 1231 (Pa. 1998).
