Robert Maizel – Trial Lawyer

I became a trial lawyer to help people; to represent the injured or aggrieved person. Robert Maizel, Esquire has over fifteen years experience as an expert trial lawyer.

My passion is to represent people who have been the victim of sexual abuse, sexual discrimination, abuse in a foster care home, subjected to discrimination at work, or just injured. As many people know, I am an avid marathon runner and a former USCF Category Bicycle Racer. My passions also are seeded in representing people who are injured on a bicycle, injured running, or even injured while in a gym.

I represent people in the State and Administrative Courts of Pennsylvania, have successfully tried cases to multi-million dollar verdicts, and have settled multi-million dollar actions. I represented Norman Monroe against Mercy Hospital and obtained a $3,350,000.00 verdict after a 5 day trial in front of 12 jurors.

My focus is to represent seriously injured persons in State and Administrative Courts, to represent persons who have been abused, and to represent persons who have been terminated or subjected to adverse employment decisions by their employer.  Mr. Maizel is at home in the Court Room.

Robert Maizel’s practice has also involved appeals from trial to the Superior Court of Pennsylvania where he has been successful in having the Trial Court overturned.  Robert Maizel has appeared in front of both the Pennsylvania Super and Commonwealth Courts over a dozen times representing clients with complex Appellate issues.

Mr. Maizel has successfully petitioned to Pennsylvania Supreme Court and was granted Certiorari to argue the matter of Gussom v. Teagle, 247 A3d 1046 (Pa. 2021). This matter created the current law on the issue of Service of Process in the Commonwealth of Pennsylvania.  Click this link to view Mr. Maizel’s Supreme Court Argument.

Mr. Maizel has been published in the Federal Reporter for his successful work as the lead attorney when he was formerly admitted in the Federal Courts representing a woman who was terminated by St. Mary’s Medical Center, Lowenstein v. Catholic Health East, 820 F.Supp.2d 639 (E.D.Pa. 2011). In this action Ms. Lowenstein was terminated from her position as a pharmacist in violation of the Family Medical Leave Act (FMLA) and in violation of the Americans With Disability Act (ADA). This reported case addresses the issues related to exhaustion of administrative remedies and holds that (1) once a charge of some form is filed with the EEOC, the resulting private litigation is defined by the scope of the EEOC investigation; and (2) EEOC charges are given liberal construction and the failure to “check a particular box” on an EEOC charge is not failure to exhaust administrative remedies, so long as the EEOC has cognizance of the situation. Mr. Maizel’s published opinion is the authoritative case on the issues related to EEOC Charges and subsequent cases filed in the District Courts of Pennsylvania.

Trial Lawyers College

Mr. Maizel has attended the intensive multi day classes offered by the Trial Lawyer’s College and has become a “Warrior” in the Courtroom.  The College calls those who have successfully completed their classes “Warriors” because they have earned the title of lawyers who fight passionately for their clients.  The College was founded and classes are still taught by the world renowned trial lawyer Gerry Spence.

Million Dollar Advocates Forum

Mr. Maizel is a Lifetime Member of the Million Dollar Advocates Forum.

Only 1 percent of all lawyers in the United States are eligible to become members of this prestigious organization.  It is Robert’s success in the courtroom that proved his eligibility for this distinction.  Selection is based on serving as lead counsel in a case where a verdict of one million dollars or more has been secured.  There are only approximately 3000 members in the United States, Canada, and England combined.

My interests include Marathon Running, Cycling, Playing Rock and Roll on my guitar, and coaching Little League / Juniors Baseball. I have a love of rock music, especially listening to The Who and Pete Townshend.
